Purpose of ESAI Tools

ESAI provides AI-assisted tools designed to help users explore their experiences, articulate their stories, and prepare for opportunities including college applications, internships, and careers.

Our tools may assist with:

• brainstorming ideas
• identifying patterns in experiences
• outlining or editing written content
• exploring personal narrative and identity
• preparing for interviews or opportunities

ESAI tools are intended to support and guide your thinking, not replace your voice or authorship. Users are responsible for reviewing and editing all content generated by ESAI tools before submitting it to schools, employers, or other institutions.

No Guarantees of Outcomes

Use of ESAI does not guarantee admission to any school, acceptance into any program, or success in any application or hiring process.

Admissions decisions, hiring outcomes, and other opportunities are determined solely by the organizations reviewing your application.

AI-Generated Content

ESAI uses artificial intelligence to generate suggestions, prompts, and insights.

While we work to make our systems helpful and reliable:

• AI outputs may not always be accurate or complete
• Responses may reflect patterns in training data
• Users should independently evaluate all outputs

Users remain fully responsible for how they use ESAI-generated suggestions or content.

Account Responsibility

If you create an ESAI account, you agree to:

• Provide accurate information
• Keep your login credentials secure
• Be responsible for activity under your account

You may also access the Services using credentials from third-party services such as Google, LinkedIn, or Apple. You are responsible for managing what information those accounts share with us.

Requests to access or delete personal information may be submitted by contacting our support team. We will respond within a reasonable timeframe, subject to legal, contractual, or educational record retention requirements.

Acceptable Use

You agree not to use ESAI to:

• violate laws or regulations
• submit misleading or fraudulent applications
• generate harmful, abusive, or deceptive content
• attempt to reverse engineer or copy ESAI systems
• pload malicious software or interfere with platform operations

ESAI reserves the right to suspend or terminate accounts that misuse the platform.

Academic and Institutional Integrity

ESAI tools are designed to support authentic self-expression and reflection.

Users are responsible for ensuring their submissions comply with the academic integrity policies and application requirements of the institutions to which they apply.

User Content and Ownership

Users retain ownership of the content they create using ESAI tools. By using ESAI, you grant ESAI permission to process your content as necessary to provide the service.

ESAI may use anonymized and aggregated data to improve its tools and services.

ESAI does not sell personal user data.

Voice Interactions

Some ESAI services may include voice-based interactions, such as conversations with Brandi. By using voice features, you consent to the processing of intereactions which may include:

• processed by AI systems
• transcribed to generate responses
• used to improve system performance

Payments and Subscriptions

Some ESAI services require a paid subscription. We use Stripe, Inc. as our payment processor. You can review Stripe's Terms at stripe.com/us/checkout/legal and Privacy Policy at stripe.com/us/privacy.

• You agree to pay all applicable fees at the prices in effect at time of purchase
• Subscriptions renew automatically unless canceled through Account Settings before the end of the current billing period
• You must provide accurate, current billing information and promptly update it if it changes
• ESAI will not refund fees already paid for the current subscription period
• Free trials must be canceled before the trial ends to avoid being charged

Refunds are subject to ESAI’s refund policy.

ESAI may modify pricing for future subscription periods.

Service Availability

We work hard to keep ESAI available and reliable, but we cannot guarantee uninterrupted access. ESAI may:

• update or improve features
• temporarily suspend services for maintenance
• modify or discontinue parts of the platform

Third-Party Services

ESAI may rely on third-party providers (such as cloud infrastructure, AI models, or communication tools) to operate our services.

ESAI is not responsible for outages or policies associated with those third-party systems.

Limitation of Liability

To the fullest extent permitted by law, ESAI is not liable for any indirect, incidental, or consequential damages resulting from the use of our services. This includes damages related to:

• admissions or hiring outcomes
• reliance on AI-generated suggestions
• interruptions to service availability

In no event shall ESAI's total liability exceed the greater of $100 or the amount you paid to ESAI in the 12 months preceding the claim.

Termination

ESAI may suspend or terminate access to the platform if users violate these Terms or misuse the service. Users may stop using ESAI at any time.

Privacy

Your privacy matters to us. Please review our Privacy Policy for details on how ESAI collects, uses, and protects user data.

Changes to These Terms

ESAI may update these Terms periodically. Continued use of ESAI after updates means you accept the revised Terms.

Governing Law

These Terms are governed by the laws of the State of New York. Any disputes not subject to arbitration will be brought in the state or federal courts located in New York County, New York.

Arbitration Agreement

Any dispute arising out of these Terms will be resolved by binding arbitration in New York County, New York under JAMS Streamlined Arbitration Rules. ESAI will pay arbitration fees for claims under $75,000. All claims must be brought individually — no class actions. You may opt out within 30 days of accepting these Terms by writing to: 29 Little W. 12th St., New York, NY 10014.
